Structure Function Claims Explained in Plain Language

Quick answer

A structure function claim describes how a nutrient affects the normal structure or function of the body, such as calcium and bones. It cannot say a product can treat, cure or prevent a disease. The FDA does not pre-approve it, the maker needs evidence, and the label must carry a disclaimer. The maker must notify the FDA within 30 days.

The rule01

What is a structure function claim?

It is a statement about what a nutrient does in the normal body, such as "calcium builds strong bones".

  • The FDA does not approve the statement before sale.
  • The maker must hold evidence, and the claim must not mislead.
  • The FDA must be told within 30 days of marketing.

The label must also say the statement has not been evaluated by the FDA and that the product is not meant to diagnose, treat, cure or prevent any disease (FDA, Structure/function claims).

The line02

How is it different from a disease claim?

A disease claim names an illness or a decline. Only approved drugs may make one.

A warning letter from the FDA and the FTC shows how this works. It treated a "nootropics" seller's pages as drug claims because they tied the products to dementia, Alzheimer's and stroke. The word nootropic was not the trigger; the disease wording was (FDA/FTC warning letter to Pure Nootropics (Feb 2019)).

Helps prevent Alzheimer's diseaseDisease claimNo, that makes it a drug

The evidence side03

Does a structure function claim mean the product was tested?

No. The claim needs substantiation, but the FDA does not check it first.

The FTC says research on one ingredient may not support a claim about a finished product, because dose, form and combination can differ (FTC, Health Products Compliance Guidance).

The VapoCept bottle render prints "Clinical Memory Restoration" and "Focus | Clarity | Energy". Those are the seller's words, and no source we found shows them. Whether they fit the rules is not ours to rule on. Studies of the listed amino acids use grams a day and look at blood vessels and exercise. Behind the wording04

What would a claim like that have to rest on?

Evidence about the finished product at its own dose. The map shows the proposed routes behind each panel line instead.

Four of the seven lines (two arginine, two citrulline) feed the proposed nitric oxide route: arginine, or citrulline turned into arginine, is the raw material for nitric oxide, which relaxes blood vessel walls. Studies use grams a day (arginine 2,000 to 24,000 mg, citrulline 6,000 to 8,000 mg), mostly for blood pressure and exercise. The listed amounts are 100 to 200 mg.

FAQ05

VapoCept questions people ask

Who approves a structure function claim?

No one approves it in advance. The maker must hold evidence, tell the FDA within 30 days of marketing, and print the disclaimer. The FDA can act afterward if the claim is false, misleading or really a disease claim.

Is memory a structure function or a disease claim?

It depends on the wording. Describing normal memory can be a structure function claim. Wording about memory loss or decline can read as a disease claim, which would make the product a drug in the FDA's eyes.

What does the FDA disclaimer on a supplement mean?

It says the FDA has not evaluated the statement and the product is not intended to diagnose, treat, cure or prevent any disease. It marks the claim as unreviewed, not as false. The VapoCept bottle's own wording was not supplied.
