Dietary Supplement vs Drug: Who Checks What Before Sale?
A drug must be shown safe and effective before sale. A dietary supplement does not need FDA approval first, and the maker is responsible for its own safety evidence and honest claims. A product that claims to treat or prevent a disease is treated as a drug. VapoCept is sold as a supplement, not a drug.

The split01
What is the difference between a dietary supplement and a drug?
A drug is reviewed before it reaches shelves. A supplement is not, and the FDA generally acts after a problem appears.
The FDA says it does not approve supplements for safety or effectiveness before sale, and it does not approve their labels either (FDA 101, Dietary supplements). Makers are responsible for the safety of what they sell and for claims that are truthful. A product represented as treating, preventing or curing a disease is regulated as a drug, even if the bottle says supplement.
Side by side02
What does the FDA check, and what does it leave to the maker?
For supplements, most checks come after the product is on sale.
| Question | Drug | Dietary supplement |
|---|---|---|
| Approved before sale? | Yes | No |
| Must show it works? | Yes, before approval | No FDA check of effectiveness |
| May claim to treat disease? | Yes, if approved for it | No |
| Who vouches for safety? | FDA review plus the maker | The maker |
| Label disclaimer? | Not needed | Required for structure and function claims |
Serious adverse events must be reported by firms to the FDA, and you can report a bad reaction yourself through the FDA's portal (FDA, Questions and answers on dietary supplements).
Claim wording03
Why do supplement labels say words like supports?
Because supplements may describe how a nutrient affects normal body structure or function, but may not claim to treat a disease.
The FDA does not pre-approve these statements. The maker needs evidence behind them, and must add a line saying the statement has not been evaluated by the FDA (FDA, Structure/function claims). That is why the front of a bottle can carry lines that read like benefits.
The VapoCept bottle render prints "Clinical Memory Restoration" and "Focus | Clarity | Energy". Those are the seller's words. We found no source showing them, and no trial tested the product. The claims versus evidence page goes through them.

FAQ05
VapoCept questions people ask
Is a dietary supplement regulated by the FDA?
Yes, but differently from a drug. The FDA does not approve supplements before sale. It can act after a product is on the market, for example if it is unsafe, mislabeled or sold with illegal disease claims.
Can a supplement claim to treat a disease?
No. A product represented as treating, preventing or curing a disease is regulated as a drug. Supplements may describe effects on normal body structure or function, with a disclaimer that the FDA has not evaluated the statement.
Does the FDA test supplements for purity?
Not before sale. The maker is responsible for safety and labeling. Seals such as GMP or FDA registered facility are seller badges unless a named certifier stands behind them, and FDA registration is not approval of the product.
